1. Parties
This agreement is made between [Company Name] ("Service Provider") and the customer who purchases the web hosting service ("Customer").
2. Subject
The purpose of this agreement is to define the terms of use of the web hosting services provided by the Service Provider to the Customer, as well as the rights and obligations of both parties.
3. Description of Service
The Service Provider shall provide hosting services including website file hosting, database access, and email hosting based on the hosting package selected by the Customer.
4. Customer Responsibilities
The Customer agrees to use the service in compliance with all applicable laws and regulations.
It is strictly prohibited to use the hosting services for sending spam emails, distributing malicious software, or hosting illegal content.
The Customer is responsible for maintaining the confidentiality of their login credentials.
In case of misuse or abuse of the service, the Service Provider reserves the right to suspend or terminate the account without prior notice.
5. Service Provider Responsibilities
The Service Provider will take necessary technical precautions to ensure a minimum of 99% uptime.
In the event of planned or unplanned service interruptions, the Service Provider shall inform the Customer as soon as possible.
Unless otherwise agreed, the Service Provider is not responsible for data backups.
6. Fees and Payments
The service fee is determined based on the selected hosting package and service duration.
If the Customer fails to make the payment on time, the service may be suspended or terminated.
If the service is not renewed before expiration, all stored data may be permanently deleted after a certain period.
7. Term and Termination
This agreement remains in effect for the duration of the hosting service.
Either party may terminate the agreement if the other party fails to comply with its terms.
No refunds shall be issued after the service has commenced, except as required by applicable consumer protection laws.
8. Data Security and Privacy
The Customer’s personal information will be kept confidential and not shared with third parties unless required by law.
The Customer is responsible for managing and backing up their own content and data.
9. Governing Law and Jurisdiction
This agreement shall be governed by the laws of the Republic of Turkey. In the event of disputes, the courts and enforcement offices of [City of the Company] shall have jurisdiction.
10. Acceptance and Entry into Force
By purchasing the hosting service, the Customer acknowledges that they have read, understood, and accepted the terms of this agreement. The agreement becomes effective upon electronic acceptance.
